1. Acceptance of Terms

By accessing or using Kaminotes (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Kaminotes provides digital fortune-telling entertainment services, including:

  • Daily Omikuji (御神籤) fortune drawings
  • Horoscope readings
  • Ema (絵馬) wishing board
  • Premium features such as Deep Readings and Detailed Horoscopes

Entertainment Disclaimer: Our services are provided for entertainment purposes only. Fortunes and horoscopes should not be relied upon for important life decisions including financial, medical, or legal matters.

3. User Accounts

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use
  • Accept responsibility for all activities under your account

4. Virtual Currency (縁/En)

Our service uses virtual currency called “縁” (En). By purchasing or using 縁, you agree:

  • 縁 has no real-world monetary value and cannot be exchanged for cash
  • 縁 purchases are final and non-refundable except as required by law
  • We may modify 縁 pricing or exchange rates at any time
  • Unused 縁 may expire if your account is inactive for 12+ months
  • 縁 cannot be transferred between accounts

5. Purchases and Payments

All purchases are processed through Stripe. By making a purchase, you agree to Stripe's terms of service. Prices are displayed in USD and may vary by region.

Refund Policy: Due to the digital nature of our services, refunds are generally not available once 縁 has been added to your account. Exceptions may be made for technical errors or at our discretion.

6. User Content

When you submit wishes to the Ema board, you grant us a non-exclusive, worldwide license to display that content on the Service. You agree not to submit content that:

  • Is illegal, harmful, or offensive
  • Infringes on others' intellectual property
  • Contains personal information about others
  • Is spam, advertising, or promotional

We reserve the right to remove any content at our discretion.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use automated systems to access the Service (bots, scrapers)
  • Circumvent rate limits or security measures
  • Create multiple accounts to abuse promotions or bonuses

8. Intellectual Property

All content, design, code, and trademarks of Kaminotes are our property or licensed to us. You may not copy, modify, distribute, or create derivative works without written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. FORTUNE READINGS ARE FOR ENTERTAINMENT ONLY AND SHOULD NOT BE RELIED UPON FOR LIFE DECISIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

12. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason. Upon termination, your right to use the Service ceases immediately, and any unused 縁 may be forfeited.

13. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify you of significant changes via email or the Service.

14. Governing Law

These terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
